1. About this Privacy Policy

This Privacy Policy explains how WorkCircuit collects, holds, uses and discloses personal information when you use the WorkCircuit website, web application and related services.

In this Privacy Policy:

  • WorkCircuit, we, us and our mean the legal operator identified above, trading as WorkCircuit;
  • you and your mean a person who uses or interacts with WorkCircuit; and
  • Platform means the WorkCircuit website, web application, systems and related services.

WorkCircuit is currently operating as a controlled beta.

We aim to handle personal information openly and transparently and to keep this Privacy Policy reasonably current with the way the Platform operates.

Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to WorkCircuit, we intend to handle personal information consistently with those requirements.

2. Privacy approach

WorkCircuit is designed as a business-to-business marketplace.

We collect information needed to operate the Platform, including information required to:

  • create and secure Accounts;
  • maintain Business Profiles;
  • publish and manage listings;
  • connect Businesses;
  • provide messaging;
  • support matching;
  • record Engagements and completion;
  • provide Reviews and reputation information;
  • operate reporting and moderation processes;
  • store uploaded business media and private evidence;
  • maintain account security;
  • provide in-app notifications; and
  • operate, maintain and improve the Platform.

We aim to collect information that is reasonably relevant to these purposes.

We do not sell personal information as a core part of the WorkCircuit business model.

3. What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not.

Some information submitted to WorkCircuit will relate primarily to a Business rather than an individual.

However, business information may still be personal information where it identifies or can reasonably identify an individual, such as a sole trader or business owner.

4. Information we collect

Depending on how you use WorkCircuit, we may collect and hold the following types of information.

4.1 Account and authentication information

This may include:

  • name or account identifier;
  • email address;
  • authentication information;
  • Account status;
  • account creation information;
  • email verification status;
  • authentication and session information;
  • account permissions and roles; and
  • information associated with maintaining Account security.

WorkCircuit does not need to display your private account email publicly simply because it is used to create an Account.

5. Business Profile information

If you create or manage a Business Profile, we may collect:

  • business name;
  • ABN;
  • business email;
  • business phone number;
  • website;
  • social media links;
  • business description;
  • services;
  • service areas;
  • industries;
  • crew information;
  • equipment;
  • years operating;
  • availability;
  • licences and accreditations supplied by the Business;
  • insurance information supplied by the Business;
  • public business logo;
  • other Business Profile information; and
  • Business Passport information.

Some Business Profile information is intended to be publicly visible.

Other information, including private contact details, is kept separate from public marketplace information where the Platform supports that distinction.

6. Public business information and private contact information

WorkCircuit distinguishes between information intended for public marketplace display and information intended to remain private.

Public information may include:

  • business name;
  • business description;
  • services;
  • service areas;
  • industries;
  • relevant availability or capability information;
  • public business logo;
  • listing information;
  • listing photographs;
  • eligible Reviews and reputation information; and
  • other information a Business chooses to make publicly available through the Platform.

Private information may include:

  • business email;
  • business phone number;
  • private ABN information;
  • private evidence or documents;
  • account information;
  • moderation information; and
  • other information not intended for public marketplace display.

A Business may choose to provide contact information to another Business through an appropriate WorkCircuit interaction, but private contact information is not automatically made public merely because it has been supplied to WorkCircuit.

7. Work Opportunities

When a Business creates a Work Opportunity, WorkCircuit may collect:

  • title;
  • description and scope;
  • service category;
  • location or service area;
  • expected work start date;
  • frequency;
  • crew requirements;
  • equipment requirements;
  • licence requirements;
  • insurance requirements;
  • job size;
  • preferred industries;
  • optional budget information;
  • photographs or other attachments; and
  • listing status and lifecycle information.

Published listing information may be visible to other WorkCircuit users as part of marketplace functionality.

Draft listings are intended to remain private to the relevant Business.

Closed and expired listings are treated according to the Platform’s listing lifecycle.

8. Capacity Listings

When a Business creates a Capacity Listing, WorkCircuit may collect:

  • listing title;
  • services;
  • locations or service areas;
  • available-from date;
  • availability;
  • crew size;
  • equipment;
  • licences and accreditations;
  • insurance information;
  • industries served;
  • one-off or ongoing availability;
  • photographs or other attachments; and
  • listing status and lifecycle information.

Published Capacity Listings may be visible to other WorkCircuit users.

Draft listings are intended to remain private to the relevant Business.

9. Matching

WorkCircuit may use information supplied by Businesses to identify potentially compatible Work Opportunities and Capacity Listings.

Matching may use information including:

  • services;
  • service areas;
  • availability;
  • crew;
  • equipment;
  • licence requirements;
  • insurance requirements;
  • industries;
  • frequency; and
  • engagement type.

Matching is intended to identify potentially compatible marketplace listings.

It is not intended to establish that an individual is suitable for a role, employment position or particular engagement.

WorkCircuit does not currently use artificial match scores to represent certainty of suitability.

Matching information may be stored as part of the operation of the Platform.

10. Connections

When a Business requests or accepts a Connection, WorkCircuit may collect and store:

  • the Businesses involved;
  • the relevant listing or marketplace context;
  • Connection status;
  • dates and times;
  • account identifiers;
  • related notifications; and
  • information associated with the Connection.

Connections may allow participating Businesses to communicate through WorkCircuit.

11. Messages

If you use WorkCircuit messaging, we may collect and hold:

  • message content;
  • sender and recipient information;
  • conversation identifiers;
  • dates and times;
  • read or unread status;
  • message-related account information; and
  • information necessary to operate messaging and related moderation functions.

Messages are not intended to be publicly displayed.

WorkCircuit may access or process message information where reasonably necessary to:

  • operate the messaging service;
  • maintain security;
  • investigate reports;
  • enforce the Marketplace Rules;
  • respond to legal obligations; or
  • protect users, WorkCircuit or the Platform.

We do not represent that private messaging is completely inaccessible to WorkCircuit or its authorised service providers.

12. Engagements and completion information

WorkCircuit may store information about Engagements between Businesses.

This may include:

  • participating Businesses;
  • relevant Connection;
  • agreed-work information recorded through WorkCircuit;
  • Engagement status;
  • work-start information;
  • completion requests;
  • completion confirmations;
  • non-confirmation of completion;
  • cancellation information;
  • dates and times; and
  • related notifications.

An Engagement record is a WorkCircuit marketplace record.

It does not make WorkCircuit a party to the commercial agreement between Businesses.

13. Reviews and reputation

Where the applicable WorkCircuit requirements are satisfied, Businesses may submit Reviews following qualifying completed Engagements.

WorkCircuit may collect and hold:

  • reviewer identity;
  • reviewed Business identity;
  • relevant Engagement;
  • structured ratings;
  • written feedback;
  • whether the reviewer would work with the Business again;
  • Review status;
  • publication status;
  • report information;
  • moderation information; and
  • reputation calculations derived from published Reviews.

Published Reviews and certain reputation information may be visible to other marketplace users.

Reviews represent the reviewer’s opinion and experience.

WorkCircuit does not treat a Review as an independent investigation or certification of a Business.

Where a Review is reported or moderated, additional information may be collected as described in the reporting and moderation sections of this Privacy Policy.

14. Business Passport and verification-related information

WorkCircuit may maintain Business Passport information.

This may include:

  • business information supplied by the Business;
  • ABN information supplied by the Business;
  • supplied licence or accreditation information;
  • supplied insurance information;
  • account verification information;
  • phone verification status where such functionality is actually available;
  • other status information actually recorded through WorkCircuit processes; and
  • reputation information derived from eligible published Reviews.

Entering information into WorkCircuit does not itself make that information verified.

For example:

  • supplying an ABN does not itself mean WorkCircuit has verified the ABN;
  • uploading insurance evidence does not itself mean WorkCircuit has verified the insurance;
  • supplying a licence does not itself mean WorkCircuit has verified the licence; and
  • supplying identity information does not itself mean WorkCircuit has completed identity verification.

Where WorkCircuit actually reviews business-supplied evidence, WorkCircuit may record information about:

  • the item reviewed;
  • review status;
  • expiry date where applicable;
  • administrative notes;
  • review date; and
  • review history.

An administrative review of one item does not mean that the entire Business or other credentials have been verified.

WorkCircuit does not currently operate live ABN/ABR verification, an external identity-verification provider, or automatic insurance or licence verification as part of the beta.

15. Photographs and public business media

Businesses may upload:

  • business logos; and
  • photographs associated with Work Opportunities or Capacity Listings.

Public business media may be displayed through the marketplace.

Current beta limits include:

  • business logos up to 10 MB;
  • up to 10 listing photographs per listing;
  • listing photographs up to 15 MB each; and
  • supported image formats including JPG/JPEG, PNG and WebP where supported by the current upload interface.

Images may be resized, compressed or otherwise optimised for Platform operation.

Businesses are responsible for ensuring they have the necessary rights and authority to upload the material.

16. Private business documents and evidence

Where available, Businesses may upload private documents or evidence relevant to their business, including:

  • insurance evidence; licence evidence; accreditation evidence; and other supporting business documents.

Current beta document limits are up to 25 MB per document, with supported formats including PDF, JPG/JPEG and PNG where supported by the current upload interface.

Private documents are stored separately from public business media.

WorkCircuit uses access controls intended to restrict private documents to authorised users, including the relevant Business and authorised WorkCircuit administration where required for Platform operation.

Private document access may use temporary or otherwise controlled access mechanisms rather than publicly exposed file links.

Uploading a document does not automatically cause the document or the underlying credential to become verified.

WorkCircuit may retain document-related metadata and review information even where a document itself is later removed, where reasonably necessary for security, administration, legal compliance or record-keeping.

17. Reporting and moderation information

WorkCircuit provides reporting and moderation functionality.

If you submit a report, WorkCircuit may collect:

  • your Account and Business identity;
  • the reported Business or content;
  • the reason for the report;
  • your description of the concern;
  • supporting information or evidence;
  • dates and times;
  • moderation status;
  • administrative decisions;
  • restrictions or other actions;
  • appeal information; and
  • related internal records.

WorkCircuit may also collect information about reports made about your Business or Account.

A report is an allegation or concern, not automatically a finding that a rule has been breached.

Moderation records may include private internal information that is not displayed to other Businesses.

18. Restrictions, suspensions and appeals

Where WorkCircuit applies a marketplace restriction, suspension or termination, we may record:

  • the affected Account or Business;
  • reason for the action;
  • action taken;
  • affected functionality;
  • start date;
  • end date where applicable;
  • internal administrative notes;
  • appeal information;
  • appeal outcome; and
  • relevant history.

If you submit an appeal, we may collect:

  • the appeal;
  • information you provide in support of it;
  • the original moderation case;
  • decision information; and
  • the outcome of the appeal.

Moderation and appeal information is generally restricted to authorised WorkCircuit personnel or systems where reasonably necessary.

19. Notifications

WorkCircuit currently provides database-backed in-app notifications.

Notifications may relate to:

Connection requests; accepted or declined Connections;

messages;

Engagement updates;

completion confirmation requests; completion confirmation; Review availability; listing expiry approaching;

  • listing expiry;
  • moderation actions;
  • restrictions;
  • suspensions;
  • termination; and
  • appeal outcomes.

Notifications are associated with the relevant Account.

WorkCircuit currently does not provide SMS or push notifications as part of the beta.

Email notification infrastructure is not currently part of the implemented beta notification system.

20. Technical information

When you use WorkCircuit, technical information may be processed as part of operating and securing the Platform.

Depending on the Platform environment and services used, this may include:

  • IP address;
  • browser information;
  • device or operating environment information;
  • authentication and session information;
  • access dates and times;
  • security events;
  • error information;
  • technical logs;
  • request information;
  • application performance information; and
  • information needed to diagnose technical problems.

WorkCircuit uses technical information for purposes including:

  • authentication;
  • security; fraud and abuse prevention; troubleshooting; error handling; service reliability; maintaining the Platform; and
  • improving technical performance.

We do not currently represent that WorkCircuit uses a conventional third-party advertising analytics system or sells technical information for advertising purposes.

The exact technical information collected may vary as the Platform and supporting infrastructure develop.

21. Error and application monitoring

WorkCircuit uses technical error and runtime reporting mechanisms to help identify application problems and improve reliability.

Information processed for this purpose may include technical error details, stack information, causes, request or session context and other information reasonably associated with diagnosing an application problem.

Where third-party technical infrastructure processes this information, it may be subject to that provider’s own privacy and security practices.

WorkCircuit will not intentionally include unnecessary personal information in error reports where reasonable steps can be taken to avoid it.

22. How we collect personal information

We generally collect personal information directly from you when you:

  • create an Account;
  • sign in;
  • create or edit a Business Profile;
  • create or edit a listing;
  • upload media or documents; request or accept a Connection; send messages;

create or participate in an Engagement; submit a Review;

report a Business or content; submit an appeal; contact WorkCircuit; or otherwise use Platform functionality.

We may also collect information automatically through technical operation of the Platform.

We may receive information from another WorkCircuit user where it is submitted as part of:

  • a Connection;
  • message;
  • Engagement;
  • Review;
  • report;
  • moderation matter; or
  • appeal.

We do not currently purchase personal information from data brokers as part of the WorkCircuit beta.

23. Purposes for collecting, holding, using and disclosing information

WorkCircuit may collect, hold, use and disclose personal information for purposes including:

Platform operation

  • creating and managing Accounts;
  • authenticating users;
  • operating Business Profiles;
  • operating listings;
  • providing matching;
  • facilitating Connections;
  • providing messaging;
  • recording Engagements;
  • supporting completion confirmation;
  • providing Reviews and reputation information;
  • delivering notifications; and
  • providing related Platform functionality.

Security and integrity

protecting Accounts; detecting misuse; preventing fraud;

  • investigating security concerns;
  • enforcing Platform rules;
  • investigating reports;
  • applying restrictions;
  • handling appeals; and
  • protecting WorkCircuit and users.

Technical operation

  • hosting;
  • storage;
  • database operation;
  • authentication;
  • troubleshooting;
  • error reporting;
  • system maintenance;
  • backup and recovery; and
  • improving Platform reliability.

Legal and administrative purposes

  • responding to lawful requests;
  • complying with applicable laws;
  • maintaining records;
  • resolving complaints;
  • protecting legal rights;
  • enforcing agreements; and
  • managing business administration.

24. How information may be disclosed

Depending on the circumstances, personal information may be disclosed to:

  • other WorkCircuit users where necessary for marketplace functionality and where the relevant information is intended to be shared;
  • service providers that support WorkCircuit;
  • hosting, database, authentication and storage providers;
  • technical support and error-monitoring providers;
  • professional advisers where reasonably necessary;
  • government agencies, regulators, courts or law enforcement where required or authorised by law; and
  • other parties where you have authorised the disclosure or it is otherwise permitted by law.

WorkCircuit does not generally disclose private business contact information to the public marketplace.

Information may be disclosed between participating Businesses where that disclosure is part of a feature they have chosen to use, such as a Connection, message, Engagement or Review.

25. Service providers and Supabase infrastructure

WorkCircuit currently uses infrastructure provided through Supabase for important backend functionality.

The WorkCircuit beta uses Supabase-related services for functions including:

  • database services;
  • authentication;
  • storage;
  • access controls;
  • application backend functionality; and
  • related infrastructure.

WorkCircuit uses PostgreSQL-backed database functionality and Supabase Storage.

Public business media and private business documents are maintained separately within the Platform’s storage architecture.

Private document access is controlled through application and storage permissions and may use temporary signed access links.

WorkCircuit does not publish private document storage URLs for unrestricted public access.

Third-party providers may process information on WorkCircuit’s behalf as necessary to provide these services.

26. Overseas disclosure and international data handling

Some service providers used by WorkCircuit may operate or process information outside Australia.

WorkCircuit’s use of third-party infrastructure may therefore involve overseas processing, storage, support or access depending on the provider, service configuration and location of relevant infrastructure.

WorkCircuit will not represent that all personal information is stored exclusively in Australia unless that has been specifically confirmed for the relevant service and configuration.

The countries involved may change as infrastructure providers, subprocessors and Platform services change.

Where applicable privacy laws require specific steps concerning overseas disclosure, WorkCircuit intends to take those steps.

The exact provider and deployment configuration should be reviewed and updated in this Privacy Policy before the Platform is treated as having a finalised production data-residency position.

27. Data storage and security

WorkCircuit uses reasonable technical and organisational measures intended to protect information against unauthorised access, loss, misuse, alteration or disclosure.

Current controls include, where applicable:

  • authenticated Accounts;
  • database access controls;
  • Row Level Security and related database policies;
  • ownership checks based on authenticated Account information;
  • separate public and private storage areas;
  • restricted private document access;
  • temporary signed access for private documents;
  • access restrictions for administrative information;
  • session-based authentication;
  • controlled Account permissions; and
  • application-level security controls.

WorkCircuit does not treat a user’s browser-submitted identity as sufficient authority to access another Business’s information.

No online service can guarantee absolute security.

28. Data breaches

WorkCircuit takes suspected data breaches seriously.

If WorkCircuit becomes aware of a suspected security incident involving personal information, we may:

  • contain the incident;
  • investigate what information and systems may be affected;
  • assess potential harm;
  • take remedial action;
  • document the incident and response; and
  • notify affected individuals, regulators or others where required by applicable law.

Where the Notifiable Data Breaches scheme applies and an incident is an eligible data breach, notification obligations may apply. An eligible data breach generally involves unauthorised access to or disclosure of personal information, or loss where unauthorised access or disclosure is likely, together with a likely risk of serious harm that has not been prevented through remedial action. WorkCircuit will not promise that every security incident will require notification because notification requirements depend on the circumstances and applicable law.

29. Retention of personal information

WorkCircuit retains personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, subject to applicable law.

Retention periods may depend on the type of information and why it was collected.

For example, WorkCircuit may need to retain information concerning:

  • Account history;
  • Business Profiles;
  • listings;
  • Connections;
  • messages;
  • Engagements;
  • Reviews;
  • reputation;
  • reports;
  • moderation decisions;
  • appeals;
  • security events;
  • legal matters; and
  • transaction or administrative records.

Some information may remain after an Account is closed where reasonably necessary for:

  • legal compliance;
  • security;
  • fraud prevention;
  • dispute handling;
  • moderation records;
  • enforcement of Platform rules;
  • accounting or business records;
  • protecting legal rights; or
  • legitimate operational purposes.

Where information is no longer reasonably required and there is no legal or operational reason to retain it, WorkCircuit may delete or de-identify it.

30. Account closure and deletion

You may request closure of your WorkCircuit Account.

Closing an Account does not necessarily mean that every record associated with the Account can be immediately deleted.

For example, information may need to be retained where reasonably necessary for:

  • legal obligations;
  • security;
  • fraud prevention;
  • moderation history;
  • disputes;
  • Reviews and reputation integrity;
  • audit records;
  • backup systems; or
  • other legitimate recordkeeping purposes.

Where applicable, WorkCircuit will consider deletion requests in accordance with applicable privacy law and the nature of the information concerned.

Public marketplace content may cease to be publicly displayed when an Account or listing is closed, subject to applicable retention requirements.

31. Access to personal information

You may contact WorkCircuit to request access to personal information we hold about you.

We will handle access requests in accordance with applicable law.

We may need to confirm your identity or authority before providing access.

There may be circumstances where access can lawfully be refused or limited.

If access is refused or limited, we will provide an explanation where required or appropriate.

32. Correction of personal information

If you believe personal information WorkCircuit holds about you is inaccurate, incomplete, out of date or misleading, you may ask us to correct it.

Where possible, you may also update information directly through your Account.

We may need to verify the requested change.

Where a correction request is accepted, we will take reasonable steps to correct the relevant information.

If we do not agree that information requires correction, we will explain the outcome where required or appropriate.

33. Complaints

If you believe WorkCircuit has mishandled your personal information or breached an applicable privacy obligation, you may contact us using the details below.

A privacy complaint should include enough information for us to understand:

  • what happened;
  • what information is involved;
  • when the issue occurred; and
  • what outcome you are seeking.

We will consider the complaint and may request further information.

Where applicable, we will investigate and respond within a reasonable period.

If you are not satisfied with our handling of a privacy complaint, you may have the right to contact the Office of the Australian Information Commissioner (OAIC).

34. Sensitive information

WorkCircuit does not generally need sensitive information to operate the core marketplace.

Sensitive information may nevertheless be provided to WorkCircuit in circumstances such as:

  • a user voluntarily including sensitive information in a message;
  • a report containing sensitive information;
  • evidence supplied during a moderation or appeal process;
  • information included in uploaded documents; or
  • other user-generated content.

You should avoid providing sensitive information unless it is reasonably necessary for the relevant WorkCircuit process.

Where WorkCircuit receives sensitive information, it will handle it in accordance with applicable law.

35. Children’s privacy

WorkCircuit is a business-to-business platform and is not intended for children.

Users should not create Accounts on behalf of children or provide children’s personal information unless they have appropriate authority and there is a legitimate reason to do so.

If WorkCircuit becomes aware that it has collected personal information from a child in circumstances where it should not have done so, we may take reasonable steps to address the situation, including deleting the information where appropriate and legally permitted.

36. Direct marketing

The current WorkCircuit beta is not intended to operate a marketing database or automated marketing campaign system.

Operational communications may be sent or displayed where reasonably necessary to operate the Platform, including notifications concerning:

  • Account activity;
  • Connections;
  • messages;
  • Engagements;
  • Reviews;
  • listing expiry;
  • moderation;
  • restrictions; and
  • appeals.

If WorkCircuit introduces direct marketing communications in the future, it will review the applicable consent, identification, unsubscribe and privacy requirements before implementing them.

37. Third-party websites and links

WorkCircuit may allow Businesses to provide website or social media links.

Those third-party websites and services are not controlled by WorkCircuit.

When you leave WorkCircuit or interact with a third-party service, that service’s own privacy practices may apply.

You should review the relevant third party’s privacy policy before providing personal information to it.

38. Public information and user responsibility

Information that a Business chooses to publish publicly through WorkCircuit may be accessible to other users and, depending on Platform configuration, potentially to people outside the Platform.

Businesses should not publish personal information they do not want publicly available.

Businesses are responsible for ensuring that information they publish is appropriate to make public and that they have the necessary rights or authority to publish it.

39. Business information supplied by sole traders

A sole trader may provide information that identifies the individual behind the Business.

Information about a Business may therefore constitute personal information even where it is supplied for a commercial purpose.

WorkCircuit may use such information for the purposes described in this Privacy Policy.

40. Anonymity and pseudonymity

Some WorkCircuit functions require identification because the Platform is designed around genuine Business Accounts and marketplace integrity.

For example, creating an Account and participating in marketplace functions generally requires an identifiable Account.

Where applicable law provides a right to deal anonymously or pseudonymously and it is practicable for WorkCircuit to accommodate that request, WorkCircuit will consider the request.

WorkCircuit may not be able to provide marketplace functionality without identifying information.

41. Changes to this Privacy Policy

WorkCircuit may update this Privacy Policy when its information handling practices, Platform functionality or legal obligations change.

The updated version will include a new version number and last-updated date.

Where a material change affects how personal information is handled, WorkCircuit will take reasonable steps to bring the change to users’ attention where appropriate.

We encourage users to review this Privacy Policy periodically.

42. Controlled beta status

WorkCircuit is currently a controlled beta.

The Platform and its information-handling practices may change as new features are developed.

Features that are not currently implemented should not be assumed to operate merely because they are mentioned as possible future functionality.

At the date of this Privacy Policy, WorkCircuit does not represent that the beta provides:

  • live ABN/ABR verification;
  • external identity verification;
  • automatic licence verification;
  • automatic insurance verification;
  • payment processing;
  • escrow;
  • subscriptions;
  • commissions;
  • SMS notifications;
  • push notifications;
  • automated marketing campaigns; or
  • other functionality not actually available through the Platform.

This Privacy Policy will be updated as material information-handling features are introduced.
